Traumatic Brain Injury:

Traumatic Brain Injury (TBI) is a term used for dysfunction causing damage suffered to the brain as a result of sudden outside physical force. All human brains are made of billions of microscopic fibers which are suspended in a cerebrospinal fluid. Beneath the skull the brain surface is full of ribbing and pronounced bony structures. Sudden impact on the head can cause tearing and bruising which result in brain damage and dysfunction, or TBI.

Symptoms of TBI can include: seizure, concussion, headache, inability to concentrate, dizziness, loss of memory as well as anxiety and depression. In order for an attorney to properly present a case for damages due to TBI they need to have a deep understanding of the symptoms. The experienced lawyers at Retamar & Millian, P.A. know to make sure you receive a CT or MRI scan that will reveal previously undetected brain injuries that may have resulted from a car accident or other trauma.

Types of TBI

A TBI occurs when momentum of the brain impacts against the skull that has been decelerated. It is typically caused by the head coming into contact with an object, such as during a car accident when it hits a windshield or the dashboard. That is declared to be a closed head injury. Another way to incur a closed head injury is when the brain is forced into a severe forward and backward movement, such as a shaken baby, or whiplash from an accident. These closed head injuries can be challenging to prove in court as there can be no obvious external symptoms denoting an injury. That does not indicate the severity of damage to the brain however.

TBI can also be the result of a penetrative head injury, for example if a bullet penetrates through the skull and pierces the brain. TBI does not include any brain injuries that are congenital or degenerative, hereditary or induced due to toxic substance, birth trauma or disease-producing organisms.
